Other things to note
We highly recommend that you purchase travel insurance. Problems can arise in multiple ways and travel insurance can be a low cost guard against losing your money if you have last minute problems and have to cancel. In the past, some of our guests have obtained insurance by going to various insurance sites for details and to purchase. We did call the people at InsureMyTrip and they do have plans that will cover for Covid issues but there are several important steps and needs to be done shortly after making your first deposit. The plans are called "Cancel For Any Reason" CFAR. Check with your insurance agent before deciding what insurance to purchase. We DO NOT endorse any insurance in particular.
VACATION RENTAL AGREEMENT
This Vacation Rental Agreement (the Agreement) is made by and between ASHWOOD RENTALS..(HOMEOWNER) and ............................................................. (Guest) as of the date last set forth on the signature page of this Agreement.

For good and valuable consideration, the sufficiency of which is acknowledged, the
parties hereby agree as follows:
1. Property: The vacation rental property is located at: 601 Winterplace Dr. Unit D106 Ghent, WV 25843
The property is fully furnished and includes: fully furnished kitchen and linens for beds. TOWELS ARE NOW PROVIDED

2. Maximum Occupancy: The maximum number of guests is limited to 10 persons (including children). Two futons are available in the living room for sleeping space.

3.Term of the rental: The vacation rental begins at 5:00 p.m. on (“Check-in Date”)
and ends at 11:00 a.m. on (the “Check-out Date”). Early check ins may be available. Contact owner if needed. Failure to adhere to the check-out time may result in an additional late fee set at $50/hour unless discussed in advance of the stay.

4. Minimum Stay: This property requires a 2 night minimum stay. Holiday weekends require a 3 night minimum stay. Longer minimum stays may be required during other periods.

5. Rental Rules: Guest agrees to abide by the Rental Rules at all times while at the
property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while residing at the property. Be respectful of the property and of neighboring guests. Repeated and/or severe complaints from neighboring guests may result in removal from property without refund.

6. Access: Guest shall allow Homeowner access to the property for purposes of repair, inspection or emergency. Homeowner shall exercise this right of access in a reasonable manner by giving at least 2 hours notice (unless in case of emergency).

7. Responsible Party: The person reserving and paying for the condo will be the responsible party and must be 25 years of age or older.

8. Housekeeping: Your paid reservation includes a charge for cleaning the condo. If, due to unforeseen circumstances (for example, severe weather, housekeeping shortage, etc.), we are unable to clean your condo prior to your stay, you will be refunded the cleaning fee. No other refunds will be given. Before checking-out, please bag and dispose of all trash in the dumpsters located outside, wash and put away the pots and pans, and start the dishwasher. We do not provide daily housekeeping service.

9.Pets: Please contact owner about any possible pets for approval. Pet deposit required.

10.Smoking: No smoking is permitted inside the dwelling. Failure to abide by this regulation will result in an automatic forfeiture of damage deposit. Smoking is only allowed in parking lots and dispose of smoking materials properly.

11. Property Missing/Damage: Please report any broken, damaged, missing or inoperable items as soon as you notice it. Even if the issue does not affect your stay, we appreciate you letting us know before you check-out so that we can make arrangements to resolve the issue prior to the next guest arrival. Please do not bring cookware or other items from one condo to another. If you have a larger group and book multiple condos, we suggest that you bring paper plates/cups to avoid moving dishes from one condo to another. Any property in the rental that is removed/broken/abused may be deducted from the security deposit

12. Water Leaks: If you encounter a major water leak, please shut-off the main water supply (found in the hall closet above the hot water heater) and call immediately. For small drips, please place a towel or bowl under the drip and notify us during normal hours. Please make sure you notify us if you suspect a leak (wet carpet, water under sink, etc) so that we can take care of it right away and minimize any damage to our condo or to a neighbor’s condo.

13. Your Belongings: Please gather all personal belongings before checking out. If we find you have left valuable items behind, we will contact you and arrange to return the items. The minimum charge to return forgotten items is $20.00 plus shipping fees.

14. Cancellation: If you cancel your reservation at least 60 days prior to your scheduled arrival date, you will receive a full refund except for a $100.00 cancellation fee (per condo) and any paid credit card fees. If you cancel your reservation less than 60 days from your arrival date, then no refunds or credit toward a different stay will be issued (except for cleaning fee, which will be refunded).

15. Refunds: There are no refunds (or credit toward a different stay) for Winterplace closures, poor snow conditions, severe weather, late arrivals, early departures, travel conditions, road closures, allergies, health or medical issues, utility or water outages, mandatory evacuation, construction at neighboring properties, war, terrorism or acts of God. We will make every
reasonable effort to ensure that the appliances, fireplaces, and like amenities are and remain in good working order. However, there is no refund if these are inoperable.

16. Trip Insurance: We understand that circumstances may arise that affect your reservation. We recommend that you purchase Trip Insurance. We do not offer trip insurance, but there are many options available if you search the internet. You should consider Cancel for Any Reason (CFAR) coverage since a typical policy without that extra coverage will not cover you in the event you want to cancel to due lack of snow, poor conditions, etc.

17. Cancellation by Owner: In the event the particular condo you have reserved is not available due to unforeseen circumstances, we will make every effort to relocate you into another one of our condos but assume no further liability. If there are no other condos available, then a complete refund will be given and we assume no further liability.

18. Condo Changes: The Owner reserves the right to change your reservation to another same-floor condo at the Owner’s discretion. Although rare, the Owner may need to assign you a different same-floor condo than the one you originally reserved due to scheduling constraints.

19. Falsified Reservations: Any reservation made under false pretenses will be subject to forfeiture of booking deposit and rental payments, and check-in will not be allowed.

20. Binding Agreement, Agency, Warrants and Venue: Your rental agreement is a binding contract between you and the property Owner. The rental contract shall be interpreted and governed by West Virginia law. Any legal action pertaining to your rental must be brought exclusively in the appropriate court within Raleigh County, State of West Virginia.

21. Defend, Indemnify and Hold Harmless: As a condition of this rental agreement, to the fullest extent permitted by law, you as Guest, on behalf of yourself, members of your party and all their successors, assigns and heirs, agree to defend, indemnify, and hold harmless the Owner and any of their employees, or representatives thereof, of and from any and all costs, suits, liabilities, damages and/or claims for damages arising from the acts or omissions of any person or which is in any other manner whatsoever related to the rental property and the related property, including but not limited to those arising from any kind of injury to or the death of any person or persons in, on or about the rental property and related property, or from any loss of or damage to the rental property or the personal property of any person or persons in, on or
about the rental property and related property, except that this indemnification does not extend to claims for personal injury actually caused solely by the grossly negligent acts or willful misconduct of the Owner or its employees.
