STONE COTTAGE AT SANCTUARY POINT SHORT-TERM RENTAL AGREEMENT
AGREEMENT
The Owners and The guest agree as follows: The guest is at least twenty-five (25) years of age (an "adult") and will be an occupant of the property during the entire reserved dates. By signing this agreement, you agree that your rental is transient in nature and does not provide you with any tenant rights pursuant to the Landlord Tenant Act of Ontario.
In addition to the guest, other authorized occupants may be family members or friends of the guest. Use of the premises will be denied to persons not falling within the foregoing categories. Should any unauthorized persons occupy or use the property, the guest shall vacate the premises immediately without any refund.
HAZARDOUS PRACTICES
No barbecue grills of any kind, other than the one provided, are permitted on the property. No open flames. I.e., Candle burning is permitted on balconies or in the unit. Do not dismantle smoke detectors as they are there for your protection. Use the overhead stove fan when cooking to avoid accidental, activation of the smoke detector alarm.
PETS POLICY
Pets are not permitted without prior approval of the Owner and subsequent payment of a non-refundable pet fee of $300. If evidence of a pet(s) without prior approval is found on the property you will be asked to vacate immediately with no refund of rent or damage deposit. AT NO TIME are pets allowed on beds or furniture. Pet feces must also be picked up. Should there be any evidence of pets being on the furniture or any pet feces on the property, the guest agrees to pay a $500.00 penalty in addition to the “pet fee”. When outside the home, pets shall always be on a leash and never left unattended.
FAMILY RENTAL ONLY
Reservations made for teenagers or young single groups will not be honoured without any accompanying adult staying in the unit at ALL Times. We require at least one member of the party to be 25 (twenty-five) years of age. Any violators will be evicted with forfeiture of all monies.
FALSIFIED RESERVATION
Any reservation obtained under false pretense will be subject to forfeiture of the reservation deposit, damage deposit, and/or balance of rental payment.
HOUSEKEEPING
There is no daily maid service. Linens and towels are included and are not to be taken from the unit. An initial setup of trash liners, bathroom paper, and soap is provided. There is a $300.00 one-time cleaning fee. Additional cleaning fees will be due in the event that cleaning involves the removal of excessive sand, pets on the furniture, or any other conditions beyond normal use. Please don't wear outside footwear in the cottage, and keep the cottage clean and neat as much as possible.
UTILITIES
No compensation will be given for a temporary outage of electricity, gas, water, cable, or internet telephone service. Outages will be reported immediately to us and all efforts will be made to have them restored as soon as possible.
SMOKING POLICY
Smoking or vaping of any tobacco, marijuana, or e-device (including “vape” devices) is strictly prohibited inside the cottage. If you smoke outside on the property, you are required to collect all butts and dispose of them safely. Your damage deposit will be forfeited, and you will incur an additional charge for cleaning and deodorizing if any evidence of smoking or vaping is found indoors.
ENTRY BY OWNER
The Owner or the Owner's Agent(s) may enter the premises under the following circumstances: in case of an emergency; to make any necessary or agreed upon repairs, alterations, or improvements; supply necessary or agreed upon services or show the premises to prospective purchasers, guests or contractors. The Owner or the Owner’s Agent(s) will provide The guest with at least 24 hours' notice of the Owner's intent to enter (except in the case of an emergency).
RULES AND REGULATIONS
1. The guest agrees to leave the premises and its contents in the same condition, neat and tidy, as The guest found the premises to be upon move-in, normal wear and tear expected. Beds should be stripped of linens and placed in a pile in each bedroom for housekeeping.
2. All dishes are to be washed and all garbage removed from the premises and placed in provided receptacles.
3. The maximum number of occupants shall not exceed 6 people, including a child in a crib.
4. Furnishings are not to be removed from the premises for use outside.
5. All keys are to be returned upon move-out by the guest. There will be a $10.00 charge per key if not returned within 2 weeks of the check-out date.
6. No unlawful activity of any kind is permitted. The guest and those present shall obey all laws of Canada, the Province of Ontario, and local bylaws. Failure to abide by the law or the above rules may cause the guest to be asked to vacate the premises and forfeit all rent and security/damage deposits.
7. The guest and any guest of the guest shall obey all local regulations including hours for use of community facilities be respectful of the neighbours and other residents of the area and shall obey all local, noise regulations and parking requirements. Any bylaw infractions incurred during the guest’s stay will be the sole responsibility of the guest
SLEEPING CAPACITY/DISTURBANCES
The guest and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy under false pretenses, occupancy exceeding the sleeping capacity of 6 people, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighbouring properties, and any other acts which interfere with neighbours' right to quiet enjoyment of their premises or any other violation of this Rental Agreement. No parties are allowed in this property, and any action which interferes with neighbours’ right to quiet enjoyment of their premises can subject you to eviction or termination of this Rental Agreement.
HOLD HARMLESS
The Owner does not assume any liability for loss, damage, or injury to persons or their personal property. Neither does the owner accept any liability for any inconveniences, damage, loss, or injury arising from any temporary defects or stoppage in the supply of water, gas, cable service, electricity, or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control.
WATERFRONT
The guest hereby acknowledges that the premises they have reserved includes a waterfront area and the undersigned guest agrees and acknowledges that the waterfront can be dangerous areas and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned guest accepts and assumes all risks involved to The guest and all of the guest's guests in or related to the use of the waterfront.
FIRES
No fires or open flames of any kind are permitted on the property without the guest applying for and obtaining a Georgian Bay Township fire permit prior to arrival at the property. The guest must abide by all fire regulations and posted levels of allowance. The guest is solely responsible for any and all damage and liability for any open flame or fires of any kind during their stay. Guests using fires or open flames without a permit during their stay will be subject to having their reservation canceled and forfeiture of all monies.
MAINTENANCE
Please report any maintenance needs for the premises to us and we will respond as quickly as possible. Refunds will not be made for maintenance issues including, but not limited to heating and air conditioning, appliances, televisions, and stereos or internet.
LINENS/TOWELS/SUPPLIES, FURNISHINGS & INVENTORY
The Owners furnish linens and towels. Any lost or damaged linens will be deducted from your deposit. An initial supply of paper products is provided. Extra items needed are the responsibility of The guest. Limited cleaning supplies may be provided. We recommend that you bring any special items that you may need. You will receive an inventory of the furnishings and supplies for the Property along with your check-in information. Please verify the Inventory and notify us of any missing Inventory items within twenty-four (24) hours of checking into the Property. The guest understands that they will be responsible for and charged accordingly for any missing, lost, or damaged Inventory items.
ADDITIONAL TERMS AND CONDITIONS
The undersigned guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges The Owner from any and all liabilities, claims, demands, and causes of action by reason of any injury, loss or damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result, or in connection with the occupancy of the premises and agrees to hold The Owner free and harmless of any claim or suit arising therefrom.
This short-term Rental Agreement shall be construed in accordance with the Province of Ontario Law. In any action concerning the rights, duties, or liabilities of the parties to or enforcement of this agreement, their principals, agents, successors, or assignees, the prevailing party shall be entitled to recover any reasonable attorney’s fees and costs, including pre-suit and appellate fees and costs. The Owner reserves the right to terminate this Agreement at their discretion at any time.
